When a Car Repair Goes Wrong

Q: Who is responsible for personal injuries sustained in an accident involving a car not repaired in accordance with the auto manufacturer’s repair manual?

"You hold the car's roof and I will apply the glue". A statement like that might conjure up an image of a parent and child playfully using glue while assembling a model car. Because no one would glue the roof onto a real car, right?

Unfortunately for one Texas couple now embroiled in a personal injury lawsuit, an auto collision shop worker admitted to using adhesive glue instead of welding to attach a new roof to a car damaged by hail dents.  

The alleged botched repair was done prior to the couple’s purchase of the car and without their knowledge. After taking ownership, the couple was subsequently involved in a car accident with the car and both were seriously injured. They claim the roof repair compromised the safety and structure of the vehicle and was to blame for the severity of their injuries after the extreme buckling of the mangled car. According to warnings in the auto manufacturer’s repair manual, people can be "killed or seriously injured" if the roof is not welded back onto the car’s body.
