Angel in the Outfield: Texas Softball Player Killed in Freak Accident

Q: Are all car accidents actionable?

Automobile accidents, in the vast majority of cases, involve strangers. That lack of familiarity makes it emotionally easier for victims to pursue a personal injury lawsuit or wrongful death lawsuit against the accident’s responsible driver.

When victims are injured in a car accident, they may be entitled to compensatory damages for their medical expenses, lost wages, pain and suffering, emotional distress, and property damage through a personal injury lawsuit. However, it is not enough to simply demonstrate that an accident occurred and injuries resulted therefrom. It must also be established that the accident and the injuries resulted from the negligence, recklessness, or malicious actions or inactions of someone else.

A wrongful death action is similar in many ways to a personal injury claim, except that instead of surviving the victim has died as a result of their injuries and the lawsuit is usually brought by their closest surviving family members who may have relied on the victim for financial support. Most often this is a surviving spouse, parent, or child. Recoverable damages include the final medical and funeral expenses for the victim, lost income, support and companionship, and more, depending on the individual facts which vary greatly in each case.

Whether a personal injury or wrongful death suit is considered, establishing liability on the part of the defendant often rests on interviewing witnesses, preserving evidence, and the outcome of the police investigation.  These civil lawsuits may be commenced even when criminal charges are not filed.

Having a skilled personal injury or wrongful death attorney on your side as soon after the accident as possible can help ensure that you receive the compensation to which you are rightfully entitled--whether through a negotiated settlement or subsequent litigation.

But what about automobile accidents where a victim has been injured or killed by a driver who is a family member or friend? That makes a terrible loss even more difficult.

A recent tragedy within the Forney High School softball team family made national headlines. A freshman player was tragically killed when a teammate reportedly accidentally ran her over after a celebratory team dinner at a player’s home on the eve of the start of the regional softball championship series.

Reportedly, some of the excited girls piled into a player’s Jeep after the house party ended and the driver did not see the victim behind the Jeep. In a case of apparent catastrophically bad timing, the victim may have fallen under the tire just as the driver began backing up. The Jeep ran over the victim who despite being airlifted to a hospital, died shortly thereafter. As expected, the entire Forney softball team, including the victim’s twin sister and the 16-year-old teammate driver was devastated. No criminal charges are expected.

All wrongful death cases are complex and unique. A skilled personal injury attorney can review all the circumstances and determine whether grounds exist to pursue a claim. Sometimes there is negligence; other times it’s just an unforeseen and unpreventable accident.

While a wrongful death action will not bring your loved one back, the compensation received can help relieve the often-devastating financial burdens resulting from your tragic and unexpected loss, like the victim’s medical and funeral expenses or the impact of losing their financial support.
